Rosebery's are always pleased to advise on the sale of Antiques and Collectables.

Valuation for Sale
We are open at the Saleroom Monday to Friday 9.30am - 5.00pm when a valuer will be available for free verbal valuations. For items too large to transport to the saleroom or large collections we will be pleased to visit you at home; again this is free of charge or any obligation. We can, where possible, give valuations from photographs by post or e-mail.

We are open at the Saleroom on the 2nd Saturday following each auction between 10 am - 2pm.

We are open at our Mayfair Office every Thursday and Friday between 10 am - 4pm, Landmark Building, 17 Hanover Square, 1st Floor, London, W1S 1HU, 020 8761 2522 for appointments.

Before the auction a pre-sale notification will be forwarded to all Vendors.

Vendors will also receive a catalogue prior to the auction and be notified of sale results after the auction.

Transport - Transport to the saleroom can be arranged through a third party carrier. Charges vary depending on the nature of the work; please contact us for more information regarding transport.

VENDORS TERMS OF SALE BY AUCTION

1. Lottage - A charge of £15.00 is made to each lot sold in addition to vendor’s commission. There is no charge for unsold lots subject to standard charges applying.

2. Vendors Commission - Is charged on each lot at a sliding scale of 15% on the first £1,000 and 10% thereafter. There is no minimum charge.

3. Loss and Damage Warranty - Rosebery’s is not regulated by the FSA for the provision of insurance to its clients. However Rosebery’s for its own protection assumes liability for property consigned at mid pre-sale estimate. To justify accepting liability, Roseberys makes a charge of 1.75% of the hammer price plus vat.

4. Marketing Costs - We will at our own discretion illustrate lots in our catalogue at a charge of £20 for a colour illustration and £10 for a black and white illustration, unless otherwise agreed with Rosebery. We do not normally illustrate items worth less than £100 except as a shared illustration. We illustrate all lots on our website, and other collector’s websites as well as inclusion in live bidding auctions at a cost of £10 per lot.

5. Storage - Charges may apply if special arrangements have to be made for storage at another location or our auction rooms. There are no storage charges for unsold lots, unless we notify a vendor in writing that we are unable to re-offer a lot. (See condition 13 below)

6. Returns - Any item(s) delivered to us that is subsequently to be returned, shall be subject to a minimum charge of £25 plus VAT in addition to any transport costs where applicable.

7. VAT - Commission, illustration and any other miscellaneous charges are subject to VAT for U.K. residents and those residents of EEC countries who are not registered for VAT

8. Buyers Premium - A buyers premium of 17.5% of the hammer price is payable by the buyer, together with VAT on this premium unless specified otherwise in the auction catalogue.

9. Settlement - Settlement is normally made by cheque 28 days after the date of the sale, subject to receipt of payment from the purchaser.(See condition 15 below)

 

TERMS OF CONSIGNMENT FOR VENDORS

10. Agency - Rosebery Fine Art Limited (Rosebery’s) acts solely as agent for the vendor and cannot be held responsible for any acts, errors, omissions or negligence of the vendor. Rosebery’s has no contractual arrangement with the buyer and cannot accept responsibility for a buyer’s default.

11. Auctioneers Authority - All goods delivered to Rosebery’s premises, will be deemed to be delivered for sale by auction unless it is otherwise stated in writing. The vendor authorises Rosebery’s to photograph and illustrate any lot and use such photographs and illustrations at any time at its discretion. The vendor further authorises Rosebery’s to deduct “vendor’s commission” together with sundry charges from the hammer price and acknowledges Rosebery’s right to retain the “buyers premium” as set out under the Vendors Terms of Sale by Auction above. Further to this you authorise us, at our discretion to negotiate a sale by private treaty not later than the close of business 3 days after the auction.

12. Reserves - (a) Prior to an auction, you are entitled to place a reserve on any lot consigned, being the minimum hammer price at which that lot may be sold. Reserves must be reasonable and we may decline to offer goods that in our opinion would be subject to an unreasonably high reserve (in which case goods are subject to the storage and insurance charges stipulated in these Terms of Consignment).

(b) A reserve once set cannot be changed except with our consent, and confirmed by you in writing.

(c) Where a reserve has been placed only we may bid on your behalf and only up to the reserve (if any) and you may in no circumstances bid personally.

13. Unsold Lots - Unsold lots will be re-entered in the next suitable auction with a 40% reduced estimate and reduced reserve, and sold at Rosebery’s discretion unless written instructions are received from the vendor to the contrary. This could be within 14 days of the last auction.

If Rosebery’s advises the vendor that it does not wish to re-enter a lot on their behalf or the vendor advises Rosebery’s that they do not wish to have a lot re-entered, the vendor shall collect or have the lot collected within 5 days of the last auction, failing which they shall be responsible for storage charges of £2 per lot per day in addition to any other charges to which they are liable.

If a lot remains uncollected 2 months after the date of auction, Rosebery’s shall have the right to sell the lot at auction without reserve and to deduct from the “hammer price” any sum owing to Rosebery’s as well as expenses arising from all auctions that the lot has been included, plus storage and insurance charges.

14. Withdrawn Lots - Where a vendor cancels instructions for sale, Rosebery’s reserve the right to make a “withdrawn lot” charge amounting to no less than 15% of Rosebery’s low estimate of the “auction price”; “owners reserve”; “suggested reserve” or the “agreed reserve” (whichever is the greater), VAT is payable thereon and any other expenses incurred.

Provisions in force concerning withdrawn lots (whether withdrawn by Rosebery’s or the vendor), which are not collected within 2 months of the sale, are identical to those in the Unsold Lots clause above.

15. Settlement - After sale settlement of the net sum due to you normally takes place within 28 days of the sale (by crossed cheque to the seller) unless the buyer has not paid for the goods. In this case no settlement will then be made but we will take your instructions in the light of our Conditions of Sale.  You authorise any sums owed by you to us on other transactions to be deducted from the sale proceeds. You must note the liability to reimburse the proceeds of sale to us as under the circumstances provided for in Condition 16 below. You should therefore bear this potential liability in mind before parting with the proceeds of sale until the expiry of 28 days from the date of auction.

16. Descriptions - Please assist us with accurate information as to the provenance etc. of goods where this is relevant.  There is strict liability for the accuracy of descriptions under modern consumer legislation and in some circumstances responsibility lies with sellers if inaccuracies occur.  We will assume that you have approved the catalogue description of your lots unless informed in writing to the contrary. Where we are obliged to return the price to the buyer when the lot is a deliberate forgery under Condition 15 of the Conditions of Sale and we have accounted to you for the proceeds of sale you agree to reimburse us the sale proceeds. The liability to you to reimburse the sale proceeds shall not arise where you are acting reasonably and honestly and are unaware of the forgery, but we are / or ought to have been aware of it.

17. Electrical Items - These are subject to detailed statutory safety controls. Where such items are accepted for sale you accept responsibility for the cost of testing by external contractors. Goods not certified as safe by an electrician (unless antiques) will not be accepted for sale. They must be removed at your expense on your being notified.  We reserve the right to dispose of unsafe goods as refuse, at your expense.

18. Soft Furnishings - The sale of soft furnishings is strictly regulated by statute law in the interests of fire safety.  Goods found to infringe safety regulations will not be offered and must be removed at your expense.  We reserve the right to dispose of unsafe goods as refuse, at your expense. The rights of disposal referred to above, are subject to the provisions of The Torts (Interference with Goods) Act 1977, Schedule 1, a copy of which is available for inspection on request.
