New Buyers
If you have not previously registered with Rosebery's for buying at auction,
please complete a registration form at reception before the auction and
provide proof of identification. Rosebery's cannot accept bids unless registration is completed prior to an auction.

Buyer's Premium
Each lot purchased is subject to a buyer's premium of 17.5% + VAT. (Please note that this will increase to 20% + VAT on 4 February 2012.)

New International Buyers

New international buyers are required to leave a £500 deposit before bidding at auction. Rosebery's will not place bids until the deposit has been taken.

Successful bidders should contact Rosebery's after the auction to settle their account, at which point their deposit will be refunded. If bidders are unsuccessful, their deposit will be refunded on the Friday after the auction.

Once a deposit has been taken it will not be necessary to do this for any future auctions.

Please note, Rosebery's is not liable for any bank charges or fluctuations in exchange rates that may occur.

VAT-able Lots

Lots subject to VAT on the hammer price are marked in the catalogues with an asterisk (*). The VAT is in addition to buyer's premium plus VAT on the buyers premium.

Buyers from outside the European Union must pay the VAT. This will then be refunded to the buyer on provision of the necessary proof of export.

VAT, which is applied to the buyer's premium and/or the Vendor's Commission and all other charges, cannot be refunded and must be paid in full in all circumstances.

Lots which appear without the (*) symbol indicate that no VAT is payable on the hammer price. This is because such lots are sold using the Auctioneers' Margin Scheme and it should be noted that the VAT included within the Premium is not recoverable as input tax.

Electrical Goods

These are sold as 'antiques' only and if bought for use must be checked over for compliance with safety regulations by a qualified electrician first.

Export Of Goods

Buyers intending to export goods should ascertain (a) whether an export licence is required and (b) whether there is any specific prohibition on importing goods of that character because, e.g. they may contain prohibited materials such as ivory. Ask Rosebery's if you need help.

Droit de Suite Royalty Charges

From 1st January 2012 artist's heirs and beneficiaries are now entitled to a resale royalty when a deceased artist's work is sold through an auction house, gallery or dealer. When an artist from a qualifying nationality has been deceased within the last 70 years the Artist Resale Right regulations are extended to the beneficiaries of the deceased artist.

A second change to the Right means that artists from some countries outside the European Economic Area (EEA) will no longer enjoy reciprocal resale rights, and UK artists will no longer receive royalties from some countries outside of the EEA.

This payment is only calculated on qualifying works of art, which are sold for a hammer price more than the UK sterling equivalent of EURO 1,000 – the UK sterling equivalent will fluctuate in line with prevailing exchange rates.

It is entirely the responsibility of the buyer to acquaint himself with the precise EURO to UK Sterling exchange rate on the day of the sale in this regard. and the auctioneer accepts no responsibility whatsoever if the qualifying rate is different to the rate indicated.

All items in the catalogue that are marked with (maybe subject to droit de suite) are potentially qualifying items, and the royalty charge will be applied if the hammer price achieved is more than the UK sterling equivalent of EURO 1,000. The royalty charge will be added to all relevant buyers'invoices, and must be paid before items can be cleared. All royalty charges are passed on to the Design and Artists Copyright Society ('DACS'), no handling costs or additional fees with respect to these charges will be retained by the auctioneers.

The royalty charge that will be applied to qualifying items which achieve a hammer price of more than the UK sterling equivalent of EURO 1,000, but less than the UK sterling equivalent of EURO 50,000 is 4%. For qualifying items that sell for more than the UK sterling equivalent of EURO 50,000 a sliding scale of royalty charges will apply - for a complete list of the royalty charges and threshold levels, please see www.dacs.org.uk. There is no VAT payable on this royalty charge.

Bidding in the Room
To bid at auction you will need to register at reception and obtain a paddle number.

Commission Bidding
If you are unable to attend the auction you can leave a commission bid, one hour before the start of the relevant section.

This will be executed by the auctioneer who will purchase the lot for you as cheaply as possible, depending on any other commission bids or reserve prices.

Telephone Bidding

Saturday Antique Auctions: For lots with a low auction estimate of £100 and above, it is sometimes possible to bid by telephone. Please speak to a member of staff for details.

Quarterly Fine Art Auctions: For lots with a low auction estimate of £200 and above, it is sometimes possible to bid by telephone. Please speak to a member of staff for details.

Condition Reports
Rosebery's is happy to give condition reports on lots, where practical.

Buyers Terms and Conditions

Payment and Collection:

Payment can be made by Cash, Cheque (where covered by a valid bank guarantee card), Switch/Delta and most major Credit Cards. Credit cards will be subject to a 2% surcharge. There is no charge for payment by Switch/Delta. Payment can be made during the auction and there will be a break after each section of the sale for collection of purchased lots.

Clearance of Goods:

Saturday Antique Auctions:

All furniture and rug lots must be cleared by 5pm on the Wednesday following the auction. All other lots must be cleared by 5pm on the Friday following the auction. Storage charges of £2 per lot per day + VAT will be strictly enforced thereafter.

Quarterly Select Auctions:

All furniture and rug lots must be cleared by 5pm on the Monday following the auction. All other lots must be cleared by 5pm on the Wednesday following the auction. Storage charges of £2 per lot per day + VAT will be strictly enforced thereafter.
