Buyer’s Terms & Conditions

All bids must be left at reception at least one hour prior to the start of the relevant section of the auction. Bids received after this time will not be accepted.

• Please telephone after the auction to see if you have been successful.
• Successful bidders shall pay the hammer price plus 20% buyer’s premium plus VAT on the premium.
• Lots marked with an asterisk (*) in the catalogue are subject to VAT on the hammer price.
• Rosebery’s endeavours to execute all absentee bids as accurately as possible but cannot be held responsible for any mistakes or omissions.
• Buyers should satisfy themselves before bidding as to the physical condition of an item. The description of a lot does not imply any item is free from defect.
• New Buyers: If you have not previously registered with Rosebery's for buying at auction, please complete a registration form at reception before the auction and provide proof of identification. Rosebery’s cannot accept bids unless registration is completed prior to an auction.
• Payment and Collection:
  Payment can be made by cash, cheque (where covered by a valid bank guarantee card), switch/delta and most major credit cards. Credit cards will be subject to a 2% surcharge. There is no charge for payment by switch/delta. Payment can be made during the auction and there will be a break after each section of the sale for collection of purchased lots.
• Clearance of Goods:

            9a.       Saturday Antique Auctions:

All furniture and rug lots must be cleared by 5.00pm on the Wednesday following the auction. All other lots must be cleared by 5.00pm on the Friday following theauction. Storage charges of £2 per lot per day + VAT will be strictly enforced thereafter.

            9b.       Quarterly Select Auctions:

All furniture and rug lots must be cleared by 5.00pm on the Monday following the auction. All other lots must be cleared by 5.00pm on the Wednesday following the auction. Storage charges of £2 per lot per day + VAT will be strictly enforced thereafter.

• Shipping of goods. Buyers must make their own arrangements for collection and delivery of purchases. (Please ask reception or see our website for recommended shippers.)
• Coloured Gems: It is common practice for gemstones to be treated in order to enhance colour and clarity. Unless stated, buyers should presume coloured stones may well have been exposed to some sort of treatment.
• Condition Reports and Images: All lots containing a large quantity of items should be viewed in person. Rosebery's is unable to give condition reports or additional images on these lots.
• Electrical Goods. These are sold as 'antiques' only and if bought for use must be checked for compliance with safety regulations by a qualified electrician first.
• Export of Goods. Buyers intending to export goods should ascertain (a) whether an export licence is required and (b) whether there is any specific prohibition on importing goods of that nature, such as ivory.
• Droit de Suite Royalty Charges:

From 14th February 2006 all UK art market professionals are required by law, to collect a royalty payment for all works of art that have been produced by living artists. This payment is only calculated on qualifying works of art,which are sold for a hammer price more than the UK sterling equivalent of EURO 1,000 - the UK sterling equivalent will fluctuate in line with prevailing exchange rates. It is entirely the responsibility of the buyer toacquaint himself with the precise EURO to UK Sterling exchange rate on the day of the sale in this regard. The auctioneer accepts no responsibility whatsoever if the qualifying rate is different to the rate indicated. All items in the catalogue that are marked as (may be subject to droit de suite) are potentially qualifying items, and the royalty charge will be applied if the hammer price achieved is more than the UK sterling equivalent of EURO 1,000. The royalty charge will be added to all relevant buyers' invoices, and must be paid before items can be cleared. All royalty charges are passed on to the Design and Artists Copyright Society ('DACS'), no handling costs or additional fees with respect to these charges will be retained by the auctioneers. The royalty charge that will be applied to qualifying items which achieve a hammer price of more than the UK sterling equivalent of EURO 1,000, but less than the UK sterling equivalent of EURO 50,000 is 4%. For qualifying items that sell for more than the UK sterling equivalent of EURO 50,000 a sliding scale of royalty charges will apply - for a complete list of the royalty charges and threshold levels, please see www.dacs.org.uk. There is no VAT payable on this royalty charge.
